Terms of Service of poplink.to
Effective Date: March 19, 2024
1. Definitions
Service – the online platform available at poplink.to, which allows Users to create custom links to external web pages with an overlay popup for collecting contact data.
Provider – the owner of the Service, poplink.to, registered in Poland.
User / Client – any natural person acting in business, legal entity or organization that uses the Service.
Subscriber – an individual whose personal data (e.g. email address) is collected via popups generated by the User through the Service.
Personal Data – Subscriber data, including email addresses, collected via popups created in the Service.
Terms – these Terms of Service.
2. Scope of the Service
The Service allows Users to:
- generate links to external web content with an overlay popup;
- collect contact details (e.g. email addresses) from Subscribers via the popup;
- access an administrative dashboard to view and export collected data.
The Provider does not own or manage the content of external websites linked by Users.
The Provider does not send marketing communications to Subscribers collected by Users.
3. Registration and Use of the Service
Using the Service requires creating a User account.
Users must provide true and accurate information when registering.
Users are responsible for maintaining the security of their account and for any activity performed using their account.
4. User Responsibilities and Legal Compliance
The User is solely responsible for:
- the legality of content promoted through generated links;
- compliance with all applicable laws regarding data collection, privacy, and electronic communications, including but not limited to GDPR;
- fulfilling all information obligations towards Subscribers whose data is collected via the Service (e.g. providing privacy notices, purpose of processing, etc.).
The Provider shall not be liable for:
- any content shared by Users,
- the consequences of the User's activities.
5. Personal Data
The User is the data controller of all Personal Data collected via popups created through the Service.
The Provider acts as a data processor on behalf of the User, as defined under GDPR and similar laws.
Personal Data collected via the Service is stored solely for the purpose of making it available to the User through the Service dashboard.
The Provider shall not use Personal Data collected via the Service for its own purposes, including marketing.
The Provider shall implement technical and organizational measures to ensure the security and confidentiality of processed data.
6. Data Processing Agreement
By accepting these Terms, the User and the Provider enter into a data processing agreement under which:
- The Provider processes Personal Data only on documented instructions from the User and only as necessary to provide the Service;
- The Provider ensures appropriate technical and organizational measures to protect Personal Data;
- The Provider assists the User in fulfilling obligations towards data subjects under GDPR (e.g. requests for access, erasure, etc.).
The User is responsible for providing legally compliant privacy notices and collecting any necessary consents from Subscribers.
7. Intellectual Property
The Service, its software, graphics, and content are protected by intellectual property laws and belong to the Provider.
The User may not copy, modify, or use any part of the Service beyond what is necessary to use the Service as intended.
8. Complaints
Any complaints regarding the Service should be sent to support@poplink.to.
The Provider shall respond to complaints within 14 business days.
9. Final Provisions
The Provider reserves the right to amend these Terms. Users will be notified of changes by email.
In matters not regulated by these Terms, the provisions of applicable laws shall apply.
Any disputes shall be settled by the competent court having jurisdiction over the Provider's registered office.
